Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the PataDeals platform, including the PataDeals mobile application, the website at https://patadeals.com, the partner and business web portals, and all related services (together, the "Platform"). The Platform is owned and operated by PataDeals Technologies Ltd ("PataDeals", "we", "us" or "our"), a limited liability company incorporated in the Republic of Kenya.
By creating an account, placing an order, sending a parcel, or otherwise using the Platform, you confirm that you have read, understood and agreed to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Platform.
1. Definitions
- "Consumer": a registered user who shops deals, places orders, books events or accommodation, earns and redeems points, or sends and receives parcels.
- "Kiosk Owner": an approved retail partner who sells products, fulfils orders and handles parcels through a registered kiosk on the Platform.
- "Ground Agent": an approved delivery rider or courier agent who collects and delivers parcels and orders on the Platform.
- "Logistics Partner": a registered and licensed logistics or courier company providing parcel carriage services on the Platform.
- "Deal Partner" / "Manufacturer": businesses that run promotions, campaigns, redemption offers or wholesale supply through the Platform.
- "Parcel": any package booked for collection and delivery through the Platform, whether between users (person-to-person) or as part of an order.
- "Wallet": the in-Platform account showing your balance of funds held on your behalf for use on the Platform.
- "Points": loyalty points earned through purchases, promotions, referrals or transfers, redeemable as described in Section 9.
2. Who may use PataDeals
2.1 You must be at least eighteen (18) years old and capable of entering into a legally binding contract under the laws of Kenya to register an account.
2.2 Business roles (such as Kiosk Owner, Ground Agent, Logistics Partner, Deal Partner or Manufacturer) require an application and approval. Approval may require verification information that we reasonably request. We may decline, suspend or revoke any business role at our reasonable discretion.
2.3 You must register with accurate, current and complete information, including a valid Kenyan mobile phone number, and keep it up to date.
3. Your account and security
3.1 Access to your account is secured by credentials such as a personal identification number (PIN), password and one-time passcodes (OTPs), together with additional security controls we apply from time to time. You are responsible for keeping all your credentials confidential.
3.2 Never share your PIN or OTP with anyone, including anyone claiming to work for PataDeals. PataDeals staff will never ask for your PIN or OTP. All actions carried out through your account using your credentials are treated as authorised by you.
3.3 Sensitive account actions (including changes to your PIN or registered phone number, cash-outs and certain transactions) require additional verification, which may include OTPs and your account PIN.
3.4 If you suspect unauthorised access, change your PIN immediately and contact support (Section 17). You may also freeze your account from Settings → Account in the app.
3.5 One person may hold multiple roles (for example, a Kiosk Owner is also a Consumer). Each role is subject to any additional terms applicable to that role.
4. The Platform services
PataDeals provides a technology platform that connects consumers, retailers, brands, deal partners, agents and delivery companies. Depending on your role, the Platform enables you to shop products and deals, earn and redeem rewards, book events and accommodation, support community causes, send and receive parcels, sell and fulfil orders, or provide delivery services, as made available in the app and portals from time to time.
PataDeals acts as an intermediary and marketplace operator. Except where we expressly sell goods directly (for example, the HQ store), products sold by kiosks, deals offered by partners, and bookings for third-party events or accommodation are contracts between you and that third party. We facilitate the transaction, payment and delivery.
5. Orders, pricing and availability
5.1 Prices shown on the Platform are in Kenya Shillings (KES) and, where applicable, are inclusive of Value Added Tax. Delivery fees, service fees and any special-handling surcharges are shown before you confirm a transaction.
5.2 An order is confirmed when you receive an order confirmation in the app. A kiosk or seller may decline or cancel an order that cannot be fulfilled (for example, out-of-stock items); in that case any amount paid will be refunded to your original payment method or Wallet.
5.3 We make reasonable efforts to ensure listings are accurate, but product images and descriptions are provided by sellers. In line with the Consumer Protection Act, 2012, you are entitled to goods that match their description and are of merchantable quality. If goods received are defective, not as described or wrong, report the issue through the app or to support within 48 hours of delivery and we will facilitate a replacement or refund as appropriate.
5.4 Event tickets and hotel bookings are subject to the venue's or property's own terms, including their cancellation and refund policies, which are displayed at booking.
6. Parcel and delivery services
6.1 Booking. Parcels are booked in the app: you request a quote based on the details you provide, confirm, and pay the quoted price. The person who books the parcel (the "Sender") is responsible for the accuracy of all declared details.
6.2 Mandatory declarations. When booking you must:
(a) provide a truthful description and/or photograph of the parcel's appearance and contents;
(b) declare whether the parcel contains batteries;
(c) declare any special-handling condition (fragile, perishable, foodstuff, pharmaceutical, livestock, biohazard), for which surcharges apply; and
(d) confirm that the contents are legal to possess and transport in Kenya.
6.3 Prohibited items. You must not send, and we will refuse, seize or surrender to the authorities:
- illegal drugs and narcotic substances (Narcotic Drugs and Psychotropic Substances (Control) Act, 1994);
- firearms, ammunition, weapons or component parts (Firearms Act, Cap 114);
- explosives, fireworks, corrosives, flammables and other dangerous goods;
- poisons and toxic substances;
- counterfeit goods (Anti-Counterfeit Act, 2008) and stolen property;
- cash, bearer instruments or items whose carriage is restricted under the Kenya Information and Communications Act and Communications Authority of Kenya courier regulations;
- wildlife trophies and products restricted under the Wildlife Conservation and Management Act, 2013; and
- any item that is dangerous, illegal or requires a licence the Sender does not hold.
We may inspect any parcel where we reasonably suspect it contains prohibited items, and we cooperate with law enforcement, including under the Computer Misuse and Cybercrimes Act, 2018 and other applicable laws. The Sender is fully liable for all losses, penalties and damage caused by undeclared or prohibited contents.
6.4 Packaging. The Sender must pack items adequately for transport. We are not liable for damage arising from inadequate packaging or from inherent defects in the goods (for example, perishables that expire in transit within the quoted delivery window).
6.5 Delivery confirmation. Delivery to the person presenting the correct delivery PIN at the delivery location constitutes valid delivery. Keep your delivery PIN confidential and share it only with the delivery agent once the parcel is in your hands.
6.6 Delivery times. Delivery times shown at booking are estimates, not guarantees, and may be affected by weather, traffic, security conditions or force majeure. Delays can be reported to support at any time.
6.7 Failed delivery and uncollected parcels. If delivery fails (wrong address, recipient unreachable, recipient refuses), we will contact the Sender to arrange redelivery (additional fees may apply) or return. Parcels unclaimed for thirty (30) days after notice may be disposed of or donated, and perishables may be disposed of earlier, without further liability to us.
6.8 Insurance and liability for parcels is governed by our Parcel Insurance policy, which forms part of these Terms.
6.9 Delivery partners. PataDeals partners with registered parcel delivery companies: courier and logistics operators duly registered in Kenya and licensed as applicable by the Communications Authority of Kenya: for parcel delivery. Physical carriage of your parcel may be performed by one or more of these partner companies. Delivery personnel act as independent contractors or as staff of our delivery partners, not as employees of PataDeals, except where expressly stated. Regardless of which partner carries your parcel, your booking, tracking, support and any claims are all handled through PataDeals as your single point of contact.
7. Payments, Wallet and cash-outs
7.1 The Platform accepts payments by M-Pesa (STK push and paybill), debit/credit card, and, for eligible roles, the in-Platform Wallet. Payment processing is provided by third-party payment service providers regulated under the National Payment System Act, 2011 and by the Central Bank of Kenya.
7.2 Your Wallet reflects funds held for your benefit (for example, sales income, delivery earnings, refunds). The Wallet is not a bank account and does not earn interest.
7.3 Cash-outs (withdrawals) require verification, including your account PIN, and may be subject to security and compliance checks before processing. We may delay or decline a payout where fraud, error or a legal obligation requires it, and we will tell you why unless the law prevents us.
7.4 Where a business account allows staff or team members to transact, they do so within the permissions granted by the account owner, who remains responsible for all activity on the account. Certain actions, including cash-outs, are reserved to the account owner.
7.5 You authorise us to deduct applicable fees, commissions, reversals and amounts you owe from your Wallet or payouts. All fees are disclosed in-app before you transact.
7.6 We may be required to report certain transactions under the Proceeds of Crime and Anti-Money Laundering Act, 2009, and to carry out identity verification for that purpose.
8. Referrals
Registered users may receive a personal referral code. When a new user completes signup with your code, you may earn referral rewards, subject to the programme rules and rates shown in the app, which we may vary or withdraw at any time. Self-referrals, fake accounts and automated signups are prohibited and forfeit all related rewards.
9. Points and redemptions
9.1 Points are a loyalty benefit, have no cash value, and are not transferable outside the mechanisms provided in the app (point sharing between users is permitted in-app and is PIN-protected).
9.2 Points may be redeemed for items in the redemption catalogue or at participating outlets, following the redemption process shown in the app.
9.3 We may adjust, expire or reverse points obtained through error, fraud or abuse, and may modify the points programme with reasonable notice. Accrued points will be honoured or a fair equivalent offered if the programme is discontinued.
10. Acceptable use
You agree not to:
- break any applicable law, including the Computer Misuse and Cybercrimes Act, 2018;
- provide false information, impersonate another person, or create accounts by automated means;
- interfere with, probe, or attempt to gain unauthorised access to the Platform or other users' accounts;
- use the Platform to send prohibited items, launder money, or defraud any person;
- harass, threaten or abuse other users, agents, kiosk staff or PataDeals personnel;
- scrape, copy or resell Platform data or content without written permission; or
- circumvent fees, manipulate points, referrals, promotions or delivery assignments.
Breach of this section may result in immediate suspension or termination and may be reported to the authorities.
11. Content and intellectual property
11.1 The Platform, its software, design, trademarks, logos and content are owned by or licensed to PataDeals and protected by Kenyan and international intellectual-property law. We grant you a limited, non-exclusive, non-transferable licence to use the app and website for their intended purposes.
11.2 Content you upload (for example, parcel photos, kiosk photos, product listings) remains yours, but you grant us a worldwide, royalty-free licence to use it as needed to operate the Platform (for example, showing a parcel photo to the delivery agent). You warrant that your content does not infringe any third party's rights.
12. Privacy
Our collection and use of personal data is governed by our Privacy Policy and the Data Protection Act, 2019. By using the Platform you acknowledge the processing described there, including the sharing of delivery details (name, phone, location) with the agents and partners who fulfil your transactions.
13. Suspension, termination and account deletion
13.1 You may stop using the Platform at any time. You can freeze your account or delete it from Settings → Account in the app. Accounts holding active business roles must contact support to settle any outstanding obligations before deletion.
13.2 We may suspend or terminate your account, withhold payouts, or restrict features where we reasonably believe you have breached these Terms, where required by law, or to protect other users. Where practicable we will give you notice and an opportunity to respond.
13.3 Wallet balances lawfully due to you will be paid out on account closure, less amounts owed to us, subject to our fraud and legal checks.
14. Disclaimers and limitation of liability
14.1 The Platform is provided on an "as is" and "as available" basis. We do not warrant uninterrupted or error-free operation.
14.2 Nothing in these Terms excludes or limits liability that cannot be excluded under Kenyan law, including your statutory rights under the Consumer Protection Act, 2012 and the Sale of Goods Act (Cap 31).
14.3 Subject to 14.2: (a) our liability for a parcel is limited as set out in the Parcel Insurance policy; (b) for all other claims, our total liability arising out of or connected to the Platform in any 12-month period is limited to the greater of the fees you paid to PataDeals in that period or KES 10,000; and (c) we are not liable for indirect or consequential loss, loss of profit, or loss of data, nor for the acts of third-party sellers, venues or properties beyond our facilitation role.
14.4 We are not liable for failure or delay caused by events beyond our reasonable control (force majeure), including natural disasters, civil unrest, strikes, telecommunications or power failures, and government action.
15. Indemnity
You will indemnify PataDeals against claims, losses and costs (including reasonable legal fees) arising from your breach of these Terms, your violation of law, or the contents of parcels you send.
16. Dispute resolution and governing law
16.1 These Terms are governed by the laws of the Republic of Kenya.
16.2 Contact our support team first (Section 17); most issues are resolved within a few business days. If a dispute is not resolved within thirty (30) days, either party may refer it to mediation, and failing settlement, to arbitration in Nairobi under the Arbitration Act, 1995, by a single arbitrator appointed by agreement or, failing agreement, by the Chartered Institute of Arbitrators (Kenya Branch). Either party may instead pursue claims in the courts of Kenya, including the Small Claims Court where applicable.
16.3 Nothing in this section limits your right to lodge a complaint with the Competition Authority of Kenya, the Communications Authority of Kenya, or the Office of the Data Protection Commissioner.

We may send notices to your registered phone number (SMS), email address or by in-app notification. You can manage promotional message preferences in Settings; service and security messages (such as OTPs and delivery notifications) are part of operating your account.
18. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified in-app or by SMS/email at least seven (7) days before they take effect. Continued use of the Platform after the effective date constitutes acceptance. The current version is always available at /terms/.
19. General
If any provision of these Terms is found invalid, the remainder continues in force. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our consent; we may assign ours to a successor of the business. These Terms, the Privacy Policy and the Parcel Insurance policy constitute the entire agreement between you and PataDeals concerning the Platform.
